Mayfair Therapy - INDIVIDUAL THERAPY Terms & Conditions

These Terms and Conditions outline the agreement between the Client and Mayfair Therapy Limited ('Mayfair Therapy') regarding the provision of therapy services. By booking a therapy session (in-person or online), the Client agrees to abide by these terms and conditions.

1. Jurisdiction

1.1 These Terms and Conditions are governed by and interpreted in accordance with the laws of England and Wales. By engaging in therapy services with Mayfair Therapy, the Client agrees that any disputes arising from these Terms and Conditions, whether in contract, tort, or otherwise, will be subject to the exclusive jurisdiction of the English courts.

1.2 For Clients located outside the United Kingdom, therapy services are provided in accordance with UK regulations. It is the Client’s responsibility to ensure that receiving therapy services from Mayfair Therapy complies with any applicable laws or regulations in their country of residence. Mayfair Therapy assumes no responsibility for ensuring compliance with laws outside the UK. Regardless of the Client’s location, all legal matters 


2. Definitions

For the purposes of these Terms and Conditions, the following definitions apply:

• ‘Therapist’ – A clinician assigned by Mayfair Therapy to provide psychotherapy services.

• ‘Client’ – The individual receiving therapy services.

• ‘Insurer’ – A recognised healthcare insurer covering the cost therapy sessions, such as AXA, BUPA, Cigna, and others as listed on the Mayfair Therapy website.

• ‘Therapy Session’ – A scheduled appointment for psychotherapy services, whether in-person or online.

• ‘Subscription Service’ – A pre-arranged recurring therapy service billed at a predetermined interval.


3. BOOKING & PAYMENT

3.1 After booking a therapy appointment by either telephone, email or text, the Client, in accepting the appointment, accepts the following conditions for the appointment: The Client agrees to the Therapist contacting him/her via email or SMS/ WhatsApp /Zoom /Facetime/ other mutually agreed up on means of communication. If the Client prefers that the Therapists uses a specific method of communication (e.g., only text, or only email or only telephone call), she/he must state this in writing via email or text.

3.2.(i) Booking: Therapy appointments can only be made via the website (https://www.mayfairtherapy.clinic/appointment). Payment is made at the time of booking. A Client may make multiple appointments at the same time. The Client will receive email and SMS confirmations of their booking. The Therapist will be automatically informed of these bookings, so there is no need to inform him.

3.2(ii) Session Subscriptions: for ease of booking, Mayfair Therapy also offers a subscription service. This is also booked and paid for via the practice website. The default setting of the Subscription Service is to bill at the current session rate for one session per week. Subscription is available by request for more frequent sessions than this. Subscriptions will run until cancelled. Subscriptions must be cancelled at least thirty (30) days in advance. No refunds are offered for subscriptions sessions paid for but where the Client does not attend.

3.3. Unless otherwise agreed in writing by email, all new Clients will be required to email the Therapist their full name, birthdate, full current address, next of kin details and GP details. This information is needed as part of the intake process and future invoicing. All new insured Clients will be additionally required to provide their insurance membership number and authorisation code for invoicing purposes. These details will be verified with the Client’s insurer 48 hours before the session time. If the Client’s details cannot be verified, the Client will be contacted to provide up-to-date information.

3.4. The Therapist requires the Client to be truthful and work in the best interests of the agreement between the Therapist and the Client.

3.5. Lateness: The Client is paying for the agreed time with the Therapist and at the agreed location (physical or online/remote). It is the Client’s responsibility to attend the session on time. The Therapist will use best efforts to call and/or text the Client within 10 minutes of the scheduled start time for any therapy session (in-person and or online/remote) if the Client is late for the session. In addition, up to three call attempts will be made within 30 minutes of the scheduled start time if the Client is late for the session. After 30 minutes the Therapist has no obligation to contact the Client. The Client will be also kept updated if the Therapist is likely to be delayed more than five minutes.

3.6 No refund will be given for any late arrival at the session under any circumstances. This includes emergency or unforeseen circumstances out of the Client’s immediate control, as the seven-day (individual session) and one calendar month (subscription service) cancellation policy will still apply.

3.7 If the Client arrives late, an extension of the agreed time or rescheduling the session will not be offered.

3.8 The Therapist is not required under any circumstances to go beyond the arranged session finishing time. The session will be terminated at the end of the arranged time even if the Client has not reached his/her desired outcome.

3.9 The Therapist will use reasonable care and skill in providing the service that the Client chooses. Clients are different and so is every therapy session. There are no guarantees of successful outcomes.

3.10 It is not the responsibility of the Therapist to achieve the desired outcome for the Client. The desired outcome as an achievement of the goal(s) cannot be guaranteed or promised to the Client by the Therapist. It would be unethical to provide a guarantee for a Client’s treatment of therapy.

3.11 If the Client is not satisfied with the therapy’s outcome, there is no refund. Mayfair Therapy does not accept any liability in relation to the therapy and modalities used in session.

3.12 Support animals are welcome, but clients must inform the therapist in advance. The animal's behaviour and welfare remain the owner's responsibility. 

3.13 Children may not accompany a parent to a therapy session.

3.14 Therapeutic treatment is only provided to adults over the age of 18.

3.15 Mayfair Therapy does not prescribe medications or provide advice on medical diagnoses, conditions, illnesses, or treatments. A referral to a prescribing psychiatrist is available upon request during a therapy session.

3.16 Mayfair Therapy does not offer financial or legal advice.

4. PRICING, PAYMENT, AND METHODS OF PAYMENT

4.1 The fee for a 50-minutes uninsured/private psychotherapeutic session in-person or online/remote is £150, unless otherwise agreed. This fee is liable to change without notice and, in any case, will be subject to review every 6 months. The fee as listed on the Mayfair Therapy website is the current fee and will override any fees quoted in other documents, including these Terms and Conditions, marketing collateral or other correspondence.

4.2 A 50-minutes insured psychotherapeutic session will be covered by the insurer. Excess fees will be covered by the Client and an invoice will be sent to the Client accordingly unless the Client wishes the insurance to be charged for the excess fees. 

4.3 Payments for sessions are only taken at the time of booking. Session confirmation and an electronic receipt will be issued at the time of booking. There are no payment facilities at the therapy location and we do not accept cash.

4.4 Credit and debit cards and Paypal are accepted to pay for sessions on the website. The Client, however, is obliged to pay any related transfer fees per transaction. The Therapist bears no responsibility for any transaction fees set by any third parties.

4.5 Invoices for insured and/or uninsured therapy sessions may be processed and emailed directly to the Client, or may be submitted directly to the Client’s insurance, by a third party (e.g., secretary/invoicing company). By commencing therapy, the Client gives consent and agrees for the invoices and any of his/her personal information that is used for invoicing (e.g., name, home address, email, DOB, insurance membership number, authorisation code) for insured and/or uninsured therapy sessions to be processed and emailed directly to the Client, or be submitted directly to the Client’s insurance, by a third party (e.g., secretary/invoicing company). The Client is entitled to expect that the information above will not be used for any other purpose rather than invoicing, will be kept confidential and stored safely.

4.6 If the Client would like the Therapist to write any letters on their behalf, the time in preparing such letters will be charged £250. If the Client requires an extended report, the Client must discuss this with the Therapist. Please note that the Therapist needs a minimum of one week’s notice, if the Client requires any written documentation.

4.7 Letters to the Client’s medical insurance for the purpose of requesting further sessions, or a referral to another medical professional will not incur any additional cost. A draft will be sent to the Client to check for any errors or omissions, before agreeing the final version.

4.8 The Client is required to inform the Therapist in advance if they are seeking a professional letter of any kind or are seeking therapy as part of a legal claim.

5. CANCELLATION AND REFUNDS POLICY

5.1 Cancellations can be done via the website booking portal by the Client, with a minimum of seven days before a session required for a refund in full, or a minimum of thirty (30) calendar days to cancel a subscription.

5.2 Seven days is exactly seven days of 24-hours prior to the arranged time – e.g., an appointment arranged for 2pm Monday must be cancelled by 2pm the Monday before. Similarly, 30 calendar days is exactly 30 days of 24-hours prior to the arranged session time.

5.3 There will be no refunds for cancellations made within the seven-day (or thirty (30) days for subscriptions). This applies under any circumstances including emergencies, illness, or any situations that are out of the Client’s control.

5.4 Short Notice or unplanned emergency sessions can be booked directly with the Therapist but under the same terms and conditions for bookings, payments, or cancellation period as with a standard session. Note that emergency out-of-hours sessions are available, but the billing rate for this service is greater than that for normal working hMayfair Therapy's. The rate for this service is £300/ hour. At the Therapist’s discretion, home or hospital visits may be undertaken. In such a case, travel time is billed at the same rate.

5.5 ‘Booked Sessions’ by the Client must be paid for in full before the session at the time of booking. No refund will be issued for any cancellations or missed appointments with notice less than seven days, or thirty (30) days for subscriptions. This policy applies under all circumstances.

5.6 The Therapist will not terminate the session before its agreed time. However, if the Client desires to finish a session earlier than the agreed time, a refund for the remaining time of the session will not be given.

5.7 The Therapist can only offer an estimate of the duration of therapy based on his clinical experience. This, however, is only an estimate and therapy can be extended or terminated based on the Client’s needs and treatment’s progress.

5.8 Sometimes a Client requires more time or less overall treatment time (ie total number of sessions) than expected and this can only become known after therapy has started. If the Client is in any doubt at any point or has any questions relating to the agreed duration of therapy, the Client must raise the appropriate questions with the Therapist during an agreed therapy session.

5.9 The Therapist reserves the right to terminate a session without a refund if it is considered that the Client is a personal risk to him or anyone else in office or in the building. The appropriate services will also be alerted in all cases of violence or personal threats.

5.10 Personal threats, verbal or physical abuse and vandalism will not be tolerated, and the session will be immediately terminated. Subsequently, no refund or any monies will be given for the remaining time of the booked session.

5.11 Even though the agreed session time might be 50 minutes, the Therapist reserves the right to terminate the session if the Therapy is not considered in the best interest of the Client. The Therapist reserves the right not to disclose the reason for the session’s termination. In these circumstances, no refund will be given.

5.12 When booking is made from outside the UK, the appointment time and further communication regarding the appointment will schedule in UK time, the Therapist’s current location. If the Client has booked in the wrong time zone, the Therapist cannot be responsible for the error. This will be counted as a missed session and payable by the Client and not the Insurer if the Client is insured.

6. CONFIDENTIALITY, HEALTH, AND SAFETY

6.1 The Therapist adheres to the ethical framework and guidelines of the BACP (https://www.bacp.co.uk/events-and-resMayfair Therapy'sces/ethics-and-standards/ethical-framework-for-the-counselling-professions/)  to ensure that the Client receives a professional and competent service.


6.2 Confidentiality is agreed between the Client and the Therapist. The Client is entitled to expect that the information they give to the Therapist about themselves, and others will remain confidential. The Therapist reserves the right not to disclose to any third party any information related to therapy sessions. This applies to all circumstances even at the request of the Client. Information can be disclosed only if it is required by law.

6.3 In line with UK law and the Therapist’s ethical codes of BPS and HCPC, the Therapist reserves the right to break confidentiality and disclose session information (notes, video or audio recordings) to any relevant third parties (e.g., GP, police, social services, legal services, emergency services) if in his/her clinical opinion the Client’s safety is a risk to herself/himself or to others or is at any risk from others. The Therapist reserves the right to break confidentiality and disclose session information to child protection services if in his/her clinical opinion there is physical or sexual abuse or neglect of any person under 18 years of age. Similarly, the Therapist reserves the right to break confidentiality and disclose session information, if he/she believes that an elderly person or disabled person is being abused or neglected, to the appropriate state agency that handles abuse to elderly or disabled persons. Finally, the Therapist reserves the right to break confidentiality and disclose session information to authorities if the Client discloses any involvement with terrorism and money laundering whether it is related to drug trafficking or any other serious crime.

6.4 If the Therapist decides a confidentiality breach is necessary, s/he will endeavour to discuss this matter with the Client and any recommendations will be documented. If this discussion is not possible due to any limitations or unforeseen circumstances (e.g., time limitations, urgency of the matter, availability, illness), the Therapist may have to proceed with the breach of confidentiality without prior notice to the Client.

6.5 In order to ensure that the therapeutic process can be maximised the Client should not arrive under the influence of alcohol or non-prescribed drugs. If the Therapist has any reason to believe that this may be the case, then the Therapist will draw the session to a close/not commence a session.

6.6 Mayfair Therapy offers an emergency out-of-hours service. However, this is on an as-available basis and Mayfair Therapy cannot guarantee availability to the Client outside the planned sessions. If the Client is in danger in any way, it is the responsibility of the Client to contact emergency services (A&E), his/her GP or the Samaritans and discuss this with the Therapist in their next session.

6.7 The Client’s personal information in any session material is confidential and kept securely. However, in line with the therapy profession’s accrediting bodies, the Therapist is expected to be in regular clinical supervision to ensure high quality of psychotherapeutic services. Therefore, some information will be shared with the Therapist’s clinical supervisor and/or outside clinical supervisors who are also accredited with a professional body and abide by the ethical framework and guidelines of the profession. No personal identifiable information will be used to discuss the Client with regards to the material that would be shared. The person(s) with whom the Therapist discusses Clients’ cases are legally bound to keep information confidential.
6.8 As part of the Therapist’s aim in offering high quality service, the Therapist has found it helpful to make audio and/or video recordings of sessions. Recordings are solely used for supervision purposes with the Therapist’s clinical supervisor(s) and/or with other mental health professionals who are also accredited with a professional body and abide by the ethical framework and guidelines of the profession. Review of recordings in clinical supervision offers better insight and understanding of the presenting issues that might be helpful in the Client’s circumstances. Recordings are kept and stored safely in an external drive (password protected).

6.9 By commencing therapy, the Client consents to video/audio recordings being made of these sessions and to these recordings being used in clinical supervision to aid the work between the Therapist and the Client. The Client has the right to refuse consent to video/audio recordings and must state this in writing before the commencement of therapy.

6.10. Any material produced in the session (e.g., video/audio recordings, session notes, written homework, and psychoeducational material) is the Therapist’s intellectual property and copyright.

6.11. The Therapist also always requires confidentiality of the Client. It is not permissible for the Client to disclose any written or distributed correspondence/material related to the session before the session or post-session.

6.12. The correspondence and all therapy material shared between the Client and the Therapist is to be used only by the Client. All written and verbal communication is issued and intended according to the Client’s individual treatment plan. If the Client shares any material that was intended for his/her exclusive use, the Therapist accepts no responsibility for the material’s effecting use on any third parties. Therefore, copying, reproducing or displaying this information publicly or electronically is not permitted and legal action may be taken against the Client if that is found to be the case.

6.13. The Client under no circumstances is permitted to record (video, audio) the session (on the phone or any other device) unless the Therapist has issued consent in writing.

6.14. The Client under no circumstances is permitted to make public an unauthorised recording (video, audio) of the session on any social platform and legal action may be taken against the Client if that is found to be the case.

6.15. All related correspondence (verbal or in writing) such as by phone, email or online software is strictly for the use of the Client and the Therapist. Information can be disclosed only if it is required by law.

6.16. Responsible for processing

Mayfair Therapy Limited is the Data Controller for the Client’s confidential data. Matthew Storie-Pugh,  of 53 Davies Street, Mayfair, London, W1K  5JH is the ICO-registered Data Protection Officer and is responsible for the processing of the Client’s personal data. Both Mayfair Therapy Limited and Matthew Storie-Pugh are registered with the Information Commissioner’s Office with registration number: ZB862676.

7. HANDLING, COLLECTION, STORAGE AND USAGE OF DATA

7.1 The lawful basis for the Therapist holding and using the Client’s information is in relation to the delivery of a contract to the Client as a health care professional. In line with the practices of the therapy profession’s governing bodies, the Therapist operates under a strict code of confidentiality.

7.2 Upon starting therapy, unless otherwise agreed in writing, the Client’s basic personal information will be collected for contact, identification and invoicing purposes. These include the Client’s full name, date of birth, full home address, next of kin, GP details and insurance membership number/authorisation code (when applicable). If any of this information changes during therapy, the Client should inform the Therapist in writing providing the new information accurately.

7.3 Information is kept securely and confidentially in line with the GDPR and also the ethical framework and the code of practice of BPS, HCPC and BABCP.

7.4 Session notes or personal details of the Client are kept in electronic form and paper form. Any paper notes are kept in a secure, robust, locked filing cabinet and stored within a secure building. All digital information is stored on a domestic computer, which is protected by two-factor authentication and stored within a secure building.

7.5 The Client’s information is kept for a period of seven years following the end of therapy to comply with any obligations that are placed upon the Therapist by his/her insurers and his/her accrediting bodies.

8. CLIENTS’ RIGHTS

8.1 The Client has the right to access the clinical notes. Beyond the clinical notes, any details held about the Client are for the Therapist’s own use and not shared.

8.2 The Client has the right to request a copy of the clinical notes that the Therapist holds about her/him. If the Client would like a copy of some or all of his/hers clinical notes, then the Client must email or write to the Therapist via the contact details stated on the contact form on Mayfair Therapy’s website or directly at matthew@mayfairtherapy.clinic. Information will be provided to the Client within 30 days.

9. REVIEWS AND ENDING THERAPY

9.1 The Client and the Therapist will review sessions regularly depending on the Client’s demand or as the Therapist finds this appropriate.

9.2 The Client is not tied into any long-term commitment, and s/he may end sessions by giving seven-days’ notice in writing although a number of ending sessions depending on the length of treatment is recommended.

9.3 If the Therapist considers the Client’s needs are beyond the limits of his/her competence, the Therapist reserves the right to terminate the therapeutic contract. The Therapist will discuss this with the Client in the session and further recommendations, if possible, may be provided.

9.4 If the Therapist decides to end the therapeutic agreement with the Client due to unforeseen circumstances, he reserves the right not to disclose the reason for this decision. However, the Therapist will endeavour to give a month’s notice.

12. INFORMED CONSENT


12.1 By commencing therapy, the Client acknowledges having read the information above, and agrees with the terms and conditions of this agreement.
